These Terms of Service ("Terms") govern your use of the Chord Systems Ltd website located at chordsystems.co.ke and any services provided by Chord Systems Ltd ("we", "us", "our"). By accessing our website or engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.
Chord Systems Ltd is incorporated and operates under the laws of Kenya. These Terms are governed by and construed in accordance with the laws of Kenya.
Chord Systems Ltd provides the following services:
Specific terms for individual service engagements are set out in service agreements, installation contracts, or written quotations provided to you, which form part of your agreement with us. In the event of a conflict between those documents and these Terms, the service agreement or contract will take precedence.
All quotations are provided in Kenyan Shillings (KES) and are valid for 30 days from the date of issue unless otherwise stated. Prices are subject to change after the validity period. VAT is applicable where required under Kenyan tax law. We will not begin any chargeable work without your written or verbal confirmation of a quotation. Any scope changes after work has commenced may attract additional charges, which we will communicate to you before proceeding.
To enable us to perform our services effectively, you agree to:
Chord Systems Ltd provides a 12-month workmanship warranty on all installation work. This covers defects arising from our installation process. It does not cover damage caused by misuse, power surges, third-party interference, physical damage, or acts of nature.
Equipment and hardware carry the manufacturer's warranty, which varies by brand and product. We will assist you in processing warranty claims with manufacturers where applicable. The warranty does not affect your statutory rights under Kenyan consumer protection law.
Chord Systems Ltd is not liable for any loss, theft, damage, or injury that occurs at your premises, whether or not a security system supplied by us is installed and operational. Security systems are deterrents and detection tools — they do not guarantee the prevention of crime or other incidents.
To the maximum extent permitted by Kenyan law, our total liability to you arising from any service engagement shall not exceed the total amount paid by you for that specific service. We exclude liability for indirect, consequential, or economic losses.
All content on this website — including text, graphics, logos, and images — is the property of Chord Systems Ltd or its content suppliers and is protected under Kenyan and international intellectual property laws. You may not reproduce, distribute, or use any content from this website for commercial purposes without our prior written consent.
When using our website, you agree not to:
Your use of our website and services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We process personal data in compliance with the Kenya Data Protection Act, 2019.
Either party may terminate a service agreement by providing written notice as specified in that agreement. Immediate termination may be exercised by either party in the event of material breach. Any outstanding payment obligations survive termination.
In the event of a dispute, both parties agree to first attempt to resolve the matter through direct negotiation. If unresolved within 30 days, disputes shall be referred to mediation or arbitration in Nairobi, Kenya, before any court proceedings are commenced, in accordance with Kenyan law.
We may update these Terms from time to time. Updated Terms will be posted on this page with a revised date. Continued use of our website or services after changes are posted constitutes your acceptance of the updated Terms.
